Private Client Department
Vivash Brand LLP are committed to a high-quality service with a caring and sympathetic approach. Clients often contact us at a difficult time in their lives, perhaps following a bereavement or when an elderly relative can no longer cope with decision-making. We offer a practical and tailored service, as well as discretion, confidentiality and a high level of professionalism.
Our Private Client department can advise on the preparation of new Wills, obtaining Deputyship Orders and Lasting Powers of Attorney, and Estate Administration. While we are unlikely to be the cheapest law firm, we strive to deliver excellence in all we do and our fees reflect our expertise.
We work closely with the Office of the Public Guardian, Probate Registry and HM Revenue and Customs, enabling us to offer the latest advice with confidence.
Preparation of Wills
Making a Will is vital to ensure that your wishes are known and put into effect upon death. A valid will ensures that your estate passes to those whom you wish to benefit.
If a valid Will is not found, then the rules of intestacy will determine who can distribute your assets and who will receive your estate. A long-term partner or cohabitee could receive nothing while children and other family would benefit but only in accordance to a list of priority based on their relationship to the deceased.
We will be pleased to provide you with advice concerning your specific circumstances. Our Wills Questionnaire can be accessed here. [link to WQ]. Please bring the completed Questionnaire to your meeting with us. Following the meeting, we shall prepare a will that is unique to your needs.
We offer a will holding service free of charge and we are able to offer comprehensive advice in relation to estate planning.
We can advise on the process and application required by the Court of Protection for a person to be appointed as a Deputy to make decisions about the personal welfare or the property and financial affairs of someone who lacks capacity. The process to become a Deputy can take six months and once appointed, a Deputy is subject to ongoing supervision by the Office of the Public Guardian and the Court of Protection.
Powers of Attorney
We can offer comprehensive advice in relation to all aspects of Powers of Attorney documents.
In particular, we offer an efficient service including the preparation and registration of Lasting Powers of Attorney.
A Lasting Power of Attorney, is a legal document which, once registered, allows someone to appoint an Attorney whom they trust to make decisions on their behalf when they either lack the mental capacity or no longer wish to make those decisions themselves. Attorneys will be able to manage your financial affairs and make decisions about your personal welfare when you are no longer able to do so.
Our Factsheet sets out the information you need to consider when making these documents. [Link to Factsheet] The final page can be completed and returned to us at our meeting with you.
We are also experienced in registering Enduring Powers of Attorney.
Coping with the death of a loved one is often a time of sadness and distress for the family left behind. Professional advice to deal with the legal aspects of probate can provide practical support at a difficult time. The work involved includes gathering information in connection with assets and liabilities so as to assess the value of the estate for probate purposes. We calculate any tax payable on the estate and offer advice on how this can be mitigated. We prepare all the Court documents required to obtain the Grant of Representation. We collect in the assets of the estate and settle any liabilities including all tax matters. We also prepare detailed final estate accounts for the Executors and subsequently distribute the estate in accordance with the will, bringing the matter to a satisfactory conclusion.
We aim to assist our clients by providing a service which is efficient and professional. Our solicitors are approachable and friendly and will be pleased to provide an estimate of costs for administering an estate once full details of the estate have been obtained.
An application for a Grant of Representation can take typically 2 to 4 months to prepare. The Grant can be issued within 1 – 3 months, depending on the involvement of HMRC. Completing the administration and distribution of the estate may take a further 3 months or more, subject to other factors e.g. multiple properties, foreign assets, income tax, inheritance tax, multiple beneficiaries.
